Insurance

Advised H Life Insurance on the development and operation of their mobile platform.

Advised H Life Insurance on the legality under the Insurance Business Act and other relevant laws regarding their proposed new business venture. This involved the development and operation of a mobile platform, the “Lifestyle Care Platform (LCP),” intended to enable their corporate insurance agents to engage in consultation and sales activities related to various financial products (such as life insurance, non-life insurance, deposits, savings, funds, and credit cards) as well as real estate and automobiles, targeting general customers based on the information provided through the LCP.

Provided legal counsel regarding the establishment of a self-regulatory agreement proposed by the Insurance Agency Association.

Provided legal counsel to the Insurance Agency Association for the establishment of a self-regulatory agreement aimed at preventing the disruption of sound solicitation practices and potential harm to insurance consumers due to excessive agent recruitment among corporate insurance agencies. Taking into account the client’s objectives, drafted a preliminary agreement to ensure compliance with relevant laws and regulations.

Reviewed the overall internal systems of K Life Insurance in relation to the implementation of the Financial Consumer Protection Act.

Conducted a comprehensive review of K Life Insurance’s preparedness for the implementation of the Financial Consumer Protection Act, which took effect on March 25, 2021. Provided reasonable guidelines for handling practical tasks related to the Act.

Reviewed the risks associated with the organizational restructuring of S Life Insurance's alternative investment division.

Conducted a comprehensive review regarding the proposed organizational restructuring of S Life Insurance’s alternative investment sector. Previously, S Life Insurance directly managed alternative investments in real estate and infrastructure. However, the restructuring plan involved establishing a 100% subsidiary to handle these investments. Specifically, personnel within S Life Insurance responsible for this function would resign and then be re-employed by the subsidiary, with S Life Insurance investing in blind funds established by the subsidiary for future alternative investments. The review covered various legal aspects, including potential violations of regulations concerning the outsourcing of financial institution operations, mandatory reporting requirements to the Financial Services Commission regarding this restructuring, and potential violations of the Monopoly Regulation and Fair Trade Act.

Advised M Life Insurance on methods of raising funds through the sale of repurchase agreements (repos).

M Life Insurance anticipated a significant demand for funds at the end of the year to cover insurance policy surrender refunds and other payments. However, the short-term funding market remained unusually challenging due to events such as the Legoland crisis. The client planned to raise the necessary funds through the sale of repurchase agreements (repos), and we reviewed the relevant regulations under the Insurance Business Act and other applicable law.

Reviewed comparative insurance policies for the General Insurance Association of Korea.

rovided research services to the General Insurance Association of Korea through comparative legal reviews on various pressing insurance issues. These included regulations related to long-term care services, pet insurance, the medical advisory system pertaining to insurance claims, and dispute mediation concerning the determination of negligence ratios in liability for damages.
